Theft and Fraud
Theft can be defined as the taking of another’s property without the consent of the owner. Fraud is a more nuanced type of theft or attempted theft, which involves taking, or attempting to take another’s property through illegal or dishonest means. It can include deliberately misleading a person or institution with the goal of obtaining money or property that one is not entitled to receive.
A conviction for either of these offences can involve serious penalties, including very high fines and/or jail time, and of course, a criminal record. Allegations of theft or fraud in relation to one’s employer come before our courts on a regular basis and are taken even more seriously. These are known in legal circles as “breach of trust” thefts or frauds, and there is an even higher risk of incarceration if found guilty.

In other cases, particularly for a first-time offender in a less serious case, it may be possible to divert the charge and avoid a criminal record through community service, a charitable donation, or participation in some type of counselling or other program.
In other cases it may be appropriate to attempt to resolve the matter by way of a plea bargain that may significantly reduce the charges or penalties that you face, and possibly even avoid a criminal record. Of course, there are also many cases that will move to a full trial where the Crown must prove its case beyond a reasonable doubt in order to obtain a conviction.
